1. Acceptance of Terms
By accessing or using any ALBOE USA LLC product or service — including the SovereignMind memory engine, Guardian Shield security system, the ALBOE website, API endpoints, or Tier 1–3 hardware — you agree to be bound by these Terms of Service. If you do not agree, do not use our products.
2. Emergency Services Disclaimer
⚠️ NOT A SUBSTITUTE FOR 911: The ALBOE Guardian Shield and SovereignMind engine are observational pattern-recognition tools. They are not monitored life-safety devices. They are not medical devices. They do not contact emergency services automatically. In any medical, fire, or security emergency, always contact 911 or your local emergency number immediately. ALBOE USA LLC is not liable for any injury, death, property damage, or other loss resulting from reliance on our products in lieu of emergency services.
3. The Caregiver's Ledger Limitation
The SovereignMind engine can generate longitudinal household observation reports (the "Caregiver's Ledger"). These reports are subject to the following limitations:
- Reports are observational summaries of AI-detected patterns, not medical diagnoses.
- Reports may contain inaccuracies due to sensor limitations, environmental interference, or algorithmic non-determinism.
- Reports are intended to supplement — never replace — professional medical evaluation.
- The responsibility for medical interpretation rests solely with the attending physician, EMT, or licensed healthcare provider.
- ALBOE USA LLC disclaims all liability for medical decisions made based on Caregiver's Ledger data.
4. Software — "As-Is" Provision
All ALBOE software products are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied. This includes but is not limited to:
- The SovereignMind Memory API
- The ChromaDB vector search engine
- The Choice Gate consent protocol
- The JSONL export and fine-tuning pipeline
- All dashboard and web interfaces
ALBOE USA LLC does not warrant that the software will be uninterrupted, error-free, or free of harmful components.
5. Hardware — Tier 1–3 Product Constraints
5.1 General Hardware Disclaimer
ALBOE USA LLC sells and installs NVIDIA Hardware — including but not limited to the Jetson family, Thor, and DGX Spark — as part of the Guardian Shield product line. All hardware is provided subject to manufacturer warranties and specifications. ALBOE USA LLC is not liable for:
- Hardware failures due to power surges, outages, or environmental conditions (heat, humidity, physical damage)
- Data loss resulting from storage device (SSD/HDD) failure
- Performance degradation due to user-installed third-party software
5.2 Tier-Specific Limitations
- Tier 1 (Cloud Hybrid): Dependent on internet connectivity. Service interruptions due to ISP outages are not the responsibility of ALBOE USA LLC.
- Tier 2 (Edge AI): Local processing capabilities are constrained by the NVIDIA Jetson hardware specifications. Performance varies by model and environmental conditions.
- Tier 3 (Sovereign Elite): Includes battery backup for temporary operation during power outages. Battery runtime is estimated and not guaranteed. ALBOE USA LLC is not liable for data loss if battery capacity is exceeded during an extended outage.
6. Limitation of Liability
Maximum Liability: To the fullest extent permitted by law, ALBOE USA LLC's total liability for any claim arising from or related to our products shall not exceed the amount paid by the user for the specific product or service in the 12 months preceding the claim.
In no event shall ALBOE USA LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage.
7. User Responsibilities
By using ALBOE products, you agree to:
- Maintain the physical security of your hardware installation
- Keep your encryption keys and access credentials secure
- Not use ALBOE products for unlawful surveillance or data collection
- Not reverse-engineer, decompile, or redistribute ALBOE proprietary software
- Comply with all applicable local, state, federal, and international laws
8. Intellectual Property
All ALBOE software, branding, documentation, and proprietary algorithms are the intellectual property of ALBOE USA LLC. The SovereignMind engine, Guardian Shield protocol, and Choice Gate mechanism are trademarks of ALBOE USA LLC.
User-generated data within personal containers remains the sole property of the user.
9. Service Modifications & Termination
- ALBOE USA LLC reserves the right to modify, suspend, or discontinue any service with 30 days written notice.
- Upon termination, users will be given a minimum of 30 days to export their data via the JSONL export function.
- Users may terminate their account at any time by contacting info@alboeusa.com.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Louisiana, United States. Any disputes shall be resolved through binding arbitration in Shreveport, Louisiana, in accordance with the rules of the American Arbitration Association. Class action lawsuits are waived to the fullest extent permitted by law.
